Heard learned senior counsel Mr.K.S.Nanavati appearing with learned advocate Mr.P.K.Nanavati for the petitioner and learned AGP Mr. A. N.Shah. The petition involves issue about applicability of the provisions contained under Section-3(2)(VII) and explanation to the said clause VII of sub section-2 of Section-3. According to the respondents, the petitioner's industrial undertaking cannot be considered as new industrial undertaking. The issue requires consideration. Rule returnable on 05/07/2012.
