JUDGMENT / ORDER

The petitioner is aggrieved by the recovery proceedings initiated while an appeal is pending before the first Appellate Authority. Admittedly the appeal has been filed with a delay of one year. Defnitely the stay petition can be considered only after the first Appellate Authority is satisfied with the explanation offered for the delay. 2. In the above circumstance, the first Appellate Authority shall take up the delay condonation application as also the stay petition and consider it as expeditiously as possible, at any rate, within one month, if an application to that end is moved by the petitioner before the first Appellate Authority. The demand shall be kept in abeyance for one month and after that the issue shall be governed by the orders passed by the first Appellate Authority.
Writ petition is disposed of with the above direction.
