(Per : HONOURABLE MR.JUSTICE JAYANT PATEL) The present application is for condonation of delay of 35 days in preferring First Appeal against the judgment and award passed by the learned Reference Court which is impugned in the First Appeal.
Mr.Dave, learned AGP appears for respondents no. 1 and 3. Respondent no.2 is served. None appears on his behalf.
Considering the facts and circumstances and in view of the grounds stated in the application for condonation of delay, sufficient cause is made out. Hence, delay deserves to be condoned and therefore condoned.
Application allowed to the aforesaid extent. Rule made absolute accordingly.
