JUDGMENT / ORDER

The petitioner as per Ext.P1 'Will' claims to be the owner and in possession of the property situated in resurvey No.114/1 of Edakkunnam Village from his grandfather. The 5th respondent is the relative of the petitioner. She is having an certain extent of property in re-survey No.120/2 of Edakkunnam Village. According to the petitioner, the Revenue Authorities on resurvey found that the petitioner's property is situated in resurvey No.120/2 of Edakkunnam Village and the property of the 5th respondent is situated in resurvey No.114/1 of Edakkunnam Village. It is also evident from Ext.P7 report of the Village Officer and Ext.P8 report of the Taluk Surveyor. Therefore, the petitioner approached the Additional Tahsildar- second respondent by filing Ext.P5 to pass appropriate orders showing the actual survey number of the petitioner so as to the petitioner to pay the basic tax. Admittedly, the Additional Tahsildar has not passed any order in Ext.P5. W.P.(C) No.16511 of 2014 2
In the facts and circumstances, there shall be a direction to the second respondent to consider and pass orders on Ext.P5, after affording an opportunity of hearing to the petitioner as well as the 5th respondent. This shall be done after adverting to Exts.P7 and P8, within a period of two months from the date of receipt of a copy of this judgment.
The writ petition is disposed of as above.
