JUDGMENT / ORDER

The petitioner was directed to take steps to prevent water logging in the property situated in re-survey No.393/1-2 in Ankamaly Village by the Secretary, Ankamali Municipality. The petitioner is threatened with coercive action by Ext.P5 notice by the Secretary. The petitioner submits that the Revenue Officials are preventing the petitioner from taking steps to fill the land in order to prevent water logging on the ground that this property is a 'Nilam' as per the revenue records. Accordingly, the petitioner has approached this Court.
The learned Government Pleader submits that the property referred in Ext.P4 is only converted land in the draft data bank and it is not classified as 'Nilam' in the draft data bank under the Kerala Conservation of Paddy Land and Wet Land Act, W.P.(C) No.26946 of 2014 2 2008. In view of the fact that this property is not classified as 'Nilam' in the draft data bank, the petitioner is entitled to fill the land for the purpose mentioned in Ext.P4. The petitioner shall carryout the measures as mandated in Ext.P4 within a period of two weeks from the date of receipt of a copy of this judgment. Till then, no coercive action shall be taken against the petitioner pursuant to Ext.P5.
The writ petition is disposed of as above.
