Heard learned Advocate Mr. Patel, appearing for the applicants, learned Advocate Mr. Joshi, appearing for the respondent No.1 and learned APP Mr. Jani, appearing on behalf of respondent No.2 - State.
Both the learned Advocates, appearing for the applicants as well as for the respondent No.1, under the instruction of applicant No.1 - husband and the brother of respondent No.1 - wife, have jointly requested that the amount of maintenance awarded by the learned 2nd Additional Sessions Judge, Ahmedabad (Rural) at Mirzapur, in Criminal Misc. Application No. 19 of 2011, vide order dated 30.5.2011, be reduced to an extent of Rs.7500/- instead of Rs.9300/- awarded by the learned Judge towards the maintenance of respondent No.1 and her minor daughter.
In view of joint request made by the applicant - husband as well as the respondent No.1 - wife, the order dated 30.5.2011 passed by the learned 2nd Additional Sessions Judge, Ahmedabad (Rural) at Mirzapur, is modified to the extent that from the month of March, 2012 onwards the applicant No.1 - husband shall pay in all Rs.7500/- per month towards the maintenance of the respondent No.1 - wife and her daughter, instead of Rs.9300/- (Rs.6,000/- towards the maintenance of respondent No.1 - wife and Rs.3,300/- towards the maintenance of daughter) per month.
In view of above, interim order is vacated forthwith. This Revision Application is disposed of with above observation. Rule is made absolute to the aforesaid extent only.
Both the parties are also permitted to move before the trial Court for early disposal of main matter.
