Heard Sri R.N. Yadav, learned counsel for the petitioner and the learned Standing Counsel for the respondents no.1 to 3.
Sri R.C. Upadhyay, learned counsel has accepted notice on behalf of the respondent no.4.
It is stated that in respect of Gata no.74Kha area 0.392 hectare proceedings were initiated under Section 122B of the U.P. Zamindari Abolition & Land Reforms Act, 1950 being Case no. T2014150603411 against respondents no.5 to 9 and an order of eviction was passed on 31.7.2013, Annexure-5 to the writ petition. Thereafter, respondents no. 5 to 9 filed a recall application upon which order of 31.7.2013 was recalled by the Tehsildar on 1.2.2014 and thereafter, the matter is kept pending for the last four years.
Copy of the order sheet has been filed as Annexure-9 to the writ petition which shows that the restoration application of the respondents no.5 to 9 was allowed on 1.2.2014 and thereafter, the matter has been kept pending on one pretext or the other. This is a serious matter.
No useful purpose would be served in keeping the petition pending.
This writ petition is therefore, disposed of with a direction to the respondent no.3-Tehsildar, Tehsil Phoolpur, District Azamgarh to conclude the Case no. T2014150603411, in accordance with law, expeditiously, preferably within a period of two months from the date of receipt of a certified copy of this order.
