Heard learned counsel for the applicant.
This petition alleges disobedience of an order dated 26 October 2017 in terms of which, the learned Judge while disposing of an application under Section 482 Cr.P.C. had provided for the disposal of a Complaint Case with expedition and preferably within the period provided under the statute.
Presently and from a perusal of the order sheet appended, the Court notes that the Complaint Case itself is at the stage of recordal of evidence. The Court further notes that the accused have themselves been summoned pursuant to the bailable warrants issued.
As is evident from the order sheet of 23 April 2018, the Complaint Case is at the stage of recordal of statements under Section 313 Cr.P.C. The Court therefore finds no ground to hold the opposite party in wilful or deliberate disobedience.
While, this petition is accordingly disposed of, it is left open to the applicant to approach the Court again in case the matter is inordinately delayed.
