Heard learned counsel for the applicant and the learned AGA and perused the material on record Admit.
This application u/s 482 Cr.P.C has been filed to quash the charge sheet submitted against the applicant in case no.3128 of 2009 u/s 419, 420, 465, 468, 471 and 409 IPC, P.S. Khalilabad, district Sant Kabir Nagar pending in the Court of CJM, Sant Kabir Nagar.
Issue notice to opposite party no.2 returnable within one month for filing counter affidavit, if any, within the aforesaid period. Be it listed on 26.8.2010.
Since the earlier writ petitions in civil side filed by the complainant was dismissed, the special appeal was also dismissed and since the arrest of the applicant was stayed during the course of investigation, therefore, I do find it expedient to direct the learned Lower Court not to take any coercive methods of seeking the appearance of the accused-applicant, if accused-applicant voluntarily appears before the Lower Court as and when required on the date fixed.
