JUDGMENT / ORDER

1. The applicant-original petitioner, by way of this application, seeks permission to amend the main writ petition by adding paragraph No.9(A) as per paragraph No.1 of the present application.
2. It appears from the averments made in the application that Annexure 'G' is sought to be amended as the information is given by the respondent-authorities to the learned counsel for the applicant-original petitioner, on an application filed under the provisions of Right to Information Act, 2005.
3. Hence, Rule. Mr.Janak Raval, learned A.G.P. waives service of Rule on behalf of respondent Nos.1 and 2.
4. Though name of Mr.P.K. Shukla is shown as learned counsel appearing for opponent No.3 herein, he is not present in the Court. However, considering the amendment, his presence is not required at this stage.
5. Considering the nature of amendment as well as the averments made in the application, amendment, as prayed for, deserves to be granted.
6. Mr.Janak Raval, learned A.G.P. has candidly submitted that, in fact, what is sought to be brought on record is the information based on record of the respondents, which is obtained by the applicant-original petitioner, as aforesaid, under the provisions of Right to Information Act, 2005.
7. Accordingly, the application is allowed. Amendment be carried out forthwith. Rule is made absolute.
