1. This petition, under Articles 226 and 227 of the Constitution of India, has been filed, with the following prayers:
"(A) To Admit this Special Civil Application.
(B) To give the direction to respondents no-2 and 3 to remove the name of respondent no-1 from land of revenue survey no-202/1 paiki 3 acre 26 guntha.
(C) To give the direction to respondents no-2 and 3 to make an entry of Legal Heirs of Deceased Panchabhai Adhedbhai and Jamnaben Panchabhai in land revenue survey no-202/1 paiki 3 acre 26 guntha.
(D) Any other relief which may be deemed fit be given."
2. It transpires from the averments made in the petition that the petitioner has filed an appeal, being RTS Appeal No.5 of 2010 on 25.08.2010 before the Deputy Collector, Palitana (Taluka: Botad). The Memorandum of the appeal has also been annexed at Annexure-F.
3. It is submitted by Mr.Viral V. Dave, learned advocate for the petitioner that the said appeal has not been decided till date.
4. The learned advocate for the petitioner further submits that an appropriate direction be given to respondent No.3 (Deputy Collector) to decide the appeal, expeditiously.
5. Upon the above statement being made by the learned advocate for the petitioner, the following order is passed:
The Deputy Collector, Palitana (Taluka: Botad) shall decide RTS Appeal No.5 of 2010 on 25.08.2010, in accordance with law, within a period of 3 months, from the date of receipt of a copy of this order.
6. The petition is disposed of, in the above terms, without entering into the merits of the case.
