JUDGMENT / ORDER

1. The present Special Criminal Application under Article 226 read with Section 482 of the Code of Criminal Procedure has been preferred by the petitioners herein – original accused to quash and set aside the impugned FIR being C.R.No.I-10 of 2004 registered with Veraval Police Station for the offences punishable under Section 379 of the Indian Penal Code as well as for the offence punishable under the Mines and Minerals Act and Rules.
2. Mr.Sunil C. Patel, learned advocate appearing on behalf of the petitioners seeks permission to withdraw the present petition unconditionally.
3. Permission is accordingly granted. The present Special Criminal Application is dismissed as withdrawn. Rule is discharged. Ad-interim relief granted earlier, if any, stands vacated forthwith.
4. In view of the dismissal of main Special Criminal Application No.1188 of 2004, no order in Criminal Misc. Application No.16993 of 2011 and the same is also accordingly dismissed.
