JUDGMENT / ORDER

Court No. - 53
Case :- CRIMINAL APPEAL No. - 598 of 2019 Appellant :- Jeetu Respondent :- State Of U.P.
Counsel for Appellant :- Hardev Prajapati Counsel for Respondent :- G.A.
Hon'ble Umesh Chandra Tripathi,J.
1. Heard Sri Hardev Prajapati, learned counsel for the appellant and learned A.G.A. for the State.
2. This criminal appeal under Section 14 A (1) of Scheduled Castes & Scheduled Tribes (Prevention of Atrocities) Act, 1989 (in short "S.C./S.T. Act") has been filed challenging the judgement and order dated 27.11.2018 passed by Additional Sessions Judge, Court No. 2/Special Judge (S.C./S.T. Act), Kasganj in Special Sessions Trial No. 415 of 2017 (State Vs. Jeetu) arising out of Case Crime No. 177 of 2016, Police Station Dholna, District Kasganj whereby the appellant was convicted for the offence punishable under Section 324 I.P.C., and instead of sentencing at once, appellant was released on probation for one year.
3. As per prosecution version, 17.05.2016 at about 8:30 AM, appellant (Jeetu) caused injury to Pankaj by scissor due to which, he sustained injuries. Injured Pankaj was examined by Dr. Dasrath Singh on the same and he found one punctured wound on the left side of the chest, which may be, caused by sharped edged weapon. PW-1 (Amit Kumar), PW-2 (Rasila Devi) and PW-4 injured (Pankaj) have supported the prosecution version.
4. Accordingly, I find no infirmity in the well reasoned and well discussed judgement of the trial court.
5. Consequently, this criminal appeal is dismissed summarily.
