1. Heard learned counsel for petitioner, learned standing counsel who appears on behalf of the State-respondents.
2. Learned counsel for petitioner submits that the petitioner was earlier posted in Amroha and has now been transferred to Sambhal. During his posting in district Amroha an official quarter in Block - C/01 Type - Ist in police station Amroha Dehat was allotted to him. After his transfer on 14.10.2014 he has not been allotted any accommodation at Sambhal. Sambhal is a newly created district and the petitioner while staying at Amroha Dehat has been commuting daily to Sambhal for performing his duty. He has referred to a Circular dated 21st of November, 2016 issued from the office of the Director General of Police, U.P., Lucknow and paragraph 14 thereof wherein it has been directed that in case no official quarter is allotted in a newly created district, the employees may be allowed to retain their official quarter already allotted.

This Court finds from a perusal of the said Circular that a direction has been given to the Housing Committee to conduct a review annually with regard to the availability of accommodation in newly created districts and in case sufficient official accommodation has become available, then, the employees who are transferred to such district shall have to vacate their earlier allotted accommodation.
4. It has been submitted that his case has not been considered by the Committee and an order dated 15.10.2017 has been passed by the Superintendent of Police, Amroha imposing a penal rent upon him without giving any notice.
5. This Court finds that the petitioner is retaining the official quarter without permission from the appropriate authority and recovery of Rs.91,941/- is proposed from his dues. This Court does not find any good ground to show interference.
6. However, since the petitioner has already made a representation to the competent authority on 03.12.2017 the same may be considered in accordance with law and an appropriate order may be passed thereon.
7. The writ petition stands disposed off.
