Vide order dated 3.6.2019, Court has passed the following order:-
"Heard learned counsel for the applicants and learned A.G.A. for the State.
The present 482 Cr.P.C. application has been filed to quash the non bailable warrant dated 16.8.2018 as well as the entire proceedings of Complaint Case No. 20985 of 2016, under Sections- 323, 420 I.P.C., Police Station- Phase-II Noida, District- Gautam Budh Nagar, pending in the court of A.C.J.M., Gautam Budh Nagar.
Learned counsel for the applicants submits that earlier applicants had filed Matter Under Article 227 No. 4563 of 2018 in which Court vide order dated 18.7.2018 has granted two months time to appear before the court below, but due to unavoidable circumstances, they could not appear and ultimately non bailable warrant dated 16.8.2018 has been issued. He further submits that they may be granted only four days time to appear before the court below and till then non bailable warrant dated 16.8.2018 shall not be given effect against the applicants.
Put up this case as fresh on 7.6.2019 as first case.
Till then, non bailable warrant dated 16.8.2018 shall not be given effect against the applicants."
Pursuant to the order dated 3.6.2019, learned counsel for the applicants submits that today applicants shall surrender before the court to obtain bail and further requested that interim protection may be extended for further three days.
Considering the request of learned counsel for the applicants, interim protection granted earlier shall remain operative up to 10th June, 2019. In case applicants appear before the court below and file bail application, court below shall decide the same strictly in accordance with law.
It is made clear that in case applicants do not appear before the court below with maximum by 10th June, 2019, it is open for the court below to proceed against them in accordance with law.
