Heard Sri Rajeev Kumar Singh for the petitioner and Sri Ajeet Kumar Singh for respondents-2 to 5.
This writ petition has been filed for mandamus directing the respondents to grant 1st, 2nd and 3rd benefits of Assured Career Progression Scheme to the petitioner.
It has been stated that the petitioner was appointed on the post of Chowkidar in U.P. State Road Transport Corporation Ltd. in the year 1982. Later on, he was promoted as Conductor on 18.1.1989, but by the order dated 26.8.1991, he was reverted to his original post of Chowkidar. On 4.11.2012, he was promoted as Booking Clerk. He has attained the age of superannuation on 31.7.2016. He is entitled to the benefits of Assured Career Progression Scheme.
Counsel for the respondent however submits that as the petitioner was reverted and was granted punishment, therefore, his services cannot be treated as satisfactory service and he was not entitled for benefits of Assured Career Progression Scheme.
However, the fact as to whether the petitioner's services were satisfactory or not, has to be decided by the appropriate Authority.
Since the petitioner has moved a representation in this respect, which is pending before Regional Manager (respondent-4), as such, the writ petition is disposed of directing the Regional Manager (respondent-4) to decide the representation of the petitioner, by a reasoned and speaking order, within three months from the date of producing a certified copy of this order before him.
