This criminal revision has been filed against the order dated 6.1.1994 passed by the Special Judge, Bulandshahar in Misc. Application No. 19 of 1993, State Vs. Lal Bahadur and others, under Section 3/7 of the Essential Commodities Act, P.S. Amiya, District Bulandshahar, by which, he has rejected the application of the revisionist for releasing the empty bags and opening the seal of the godown.
A perusal of the order dated 6.1.1994 reveals that the Court had observed that investigation was pending and there was also an allegation that accused is using the bags concerned for selling the fertilizers with the false mark and, therefore, there was no justification of opening the sealed godown in favour of the applicant under Section 6-A of the Essential Commodities Act were pending.
However, by means of the order dated 4.3.1994 passed by this Court, the Court below was directed to make arrangement for opening of the seal of the godown of the applicant. Thus, the relief as prayed in the revision was partly allowed by the Court at the interim stage itself.
A perusal of the order impugned reveals that the Court below has duly considered the allegations made against the accused- revisionist and, therefore, had declined to release the bags as claimed by the revisionist. Given the nature of the allegations the Court below was justified in making such an order.
We see no good ground for interfering in the order passed by the Court below and this criminal revision is, accordingly, dismissed Order Date :- 25.8.2018 A. V. Singh
