JUDGMENT / ORDER

In the above writ petition, there was an interim order dated 15.06.2010 by which it was directed that if the sale had taken place on that day, then there shall be a stay of confirmation provided the petitioner deposits an amount of Rs.1,00,000/-. It is not clear as to whether the interim order was complied with. Even if the interim order was complied with, then if the sale had occurred, definitely the purchaser had to be impleaded. Hence, if the loan is still in default, the respondent Bank shall issue a statement of accounts to the petitioner by registered post and shall proceed against the petitioner for recovery in accordance with law. Writ petition closed, leaving open the contentions of either parties.
