Learned advocate for the applicants has placed reliance on the decision in the case of State of Haryana vs. Unique Farmaid (P) Ltd. and Ors. [(1999) 8 SCC 190 and similar decisions and contended that continuance of prosecution is vitiated in view of the sealed sample taken from the applicants and their right to send the sample to CIL without re-examination get defeated.

Considering the above, Rule. Learned APP, waives service of rule on behalf of respondent No.1.

Ad-interim relief to continue as interim relief till final disposal of the application.
