JUDGMENT / ORDER

HONOURABLE THE CHIEF JUSTICE MR. S.J. MUKHOPADHAYA) According to the petitioner, she was admitted to B.Ed. course in the J.G College of Education in the 2009-2010 and she had attended the college regularly. However, all of a sudden, the College authorities informed her that her admission was pending with the Gujarat University and till the decision is taken by the Gujarat University, she will not be entitled to appear in the examination. Being aggrieved, the petitioner preferred this writ petition for seeking direction to the respondent-authorities to allow her to appear in the final B.Ed. course Examination, as a regular student.
It appears that the petitioner passed her B.A Examination in the year 2008 from Panch Pargana Kisan College, Bundu, District-Ranchi. She subsequently came to Ahmedabad since her husband is in service in the State of Gujarat. She being successfully getting selection, got admission to B.Ed. courses in J.G College of Education. Just before the final examinations, as the college could not receive the roll number, she was informed that the matter was pending before the Gujarat University.
On 6/04/2010, notice was issued on the respondents and during the pendency of the writ petition, petitioner was allowed to appear in the B.Ed. examination; subject to decision in the case. It is submitted that the respondents allowed her to appear in the examination, however, result has not been published in view of pendency of the case.
Inspite of notice, the respondent-University has not come forward to oppose the prayers made in the writ petition. Fact as pleaded has not been denied.
In the circumstances and as we find that the petitioner was admitted in the College as a regular student and she had already appeared in the examination conducted by the Gujarat University, we direct the Gujarat University to publish her result immediately. Writ petition is allowed with the aforesaid observation. No costs.
