1. learned counsel Mr Masoom Shah, appearing for the petitioner, submitted that the impugned order dated 1.5.2012 was issued by the respondent not only without affording an opportunity of being heard to the petitioner but inspite of having complied with all the conditions of the contract. He submitted an additional affidavit of the petitioner in support of his submissions and also insisted that inspite of availability of alternative remedy, this court should admit the petition and grant necessary relief. Learned counsel has relied upon judgment of the Apex Court in Harbanslal Sahnia and Anr v. Indian Oil Corporation Ltd. And Ors. (AIR 2003 SC 2120).
2. NOTICE as to admission and interim relief returnable on 31.7.2012. Direct Service is permitted.
