Heard learned counsel for the applicant.
The petitioner has come up before this Court claiming following relief as substantial relief:
"Direct the learned Additional District Judge/ Fast Track Court Ist, Kushinagar at Padrauna to conclude the C.A. No. 20 of 2006, Heera Lal (Since Deceased) represented through L.Rs. Vs. Jeetu (Since Deceased) represented through L.Rs. and others as early as possible within the time frame."
It is argued that the civil appeal is pending for argument after written statement moved by the opposite parties-defendants. However, the same has remained pending for such a long time and therefore, appeal may be expedited.
Having heard learned counsel for the petitioner, I find that the appeal is of the year 2006 and it is a widely known fact that the State Uttar Pradesh was badly hit initially by the lockdown during the first wave of pandemic Covid-19 and so also subsequently during the 2nd wave of Covid-19 adversely affecting the judicial functions of the courts in the State.
In such above view of the matter, therefore, this Court does not find it feasible to expedite the appeal of the year 2006. However, it is expected that the court concerned shall expeditiously, preferably within a period of six months, without giving any unnecessary adjournment to either of the parties, dispose of the appeal in accordance with law.
The petition is disposed of with the aforesaid observations and directions.
