The submission of learned counsel for the petitioner is that the enquiry in continuation of the suspension order dated 31.08.2020 had been concluded and the petitioner has been exonerated of all the charges levelled against him. After reinstatement in the month of December 2020, the petitioner is working on the post of Head Constable in Police Station Karari, District Kaushambi.
Only prayer is to issue a direction to the respondents to pay the arrears of salary for the period of suspension/enquiry till the date of reinstatement and further to pay regular salary to the petitioner month by month as and when it falls due.
The grievance raised by the petitioner, in the opinion of the Court, can be addressed by the Superintendent of Police, Kaushambi. The writ petition is, therefore, disposed of without entering into the merit of the case with the direction as follows:-
1. The petitioner shall make a comprehensive representation before the Superintendent of Police, Kaushambi within a period of three weeks from today alongwith copy of this order.
2. In case, such an representation is filed, the respondent No.2 namely the Superintendent of Police, Kaushambi would be under obligation to take an expeditious decision for payment of admissible salary and other allowances to the petitioner for the period of suspension/enquiry conducted against him, in accordance with law.
