Heard learned counsel for the petitioner and learned Standing Counsel appearing for respondents no. 1 to 4. Sri V. B. Rai has accepted notice on behalf of respondent no.5.
Present petition has been filed seeking writ of mandamus commanding the District Magistrate Ballia to conduct the enquiry against the respondent no.5 (who is a sitting pradhan) under Uttar Pradesh Panchayat Raj (Removal of Pradhans and up-Pradhan and Members) Enquiry Rules, 1997, within specific period.
After some arguments, learned counsel for the petitioner prays that he may be permitted to withdraw the petition so as to avail the remedy available to him by filing proper complaint under the relevant rules.
Petition stands dismissed as withdrawn with the liberty aforesaid.
