Learned counsel for the petitioner is permitted to implead "Uttar Pradesh Expressways Industrial Development Authority through Chief Executive Officer, Lucknow" as respondent no. 4.
Heard Sri Anil Kumar, learned counsel appearing on behalf of the petitioner, Sri M.C. Chaturvedi, Senior Advocate assisted by Sri S.C. Dwivedi for newly added respondent no. 4 and respondent nos. 1 to 3 are represented by learned standing counsel for the State.
From the perusal of the averments made in the writ petition and the documents appended thereto, it appears that the instant writ petition has been filed by the petitioner on this apprehension that his land will be utilized by the respondent no. 2 for the purpose of road widening without paying any compensation.
Sri M.C. Chaturvedi, learned senior counsel has very candidly stated that till date since the petitioner's land has neither been acquired nor utilized, there is no question of paying any compensation to him. However, if and when the land is acquired or utilized for the purpose of road widening, the petitioner shall be adequately compensated in accordance with law.
In view of the statement made by Sri M.C. Chaturvedi, learned senior counsel appearing for the newly added respondent no. 4, we are of the view that no further order is required to be passed in this writ petition at this stage.
Petition disposed of accordingly.
