Jayntibhai vs State

High Court Of Gujarat|18 July, 2012

JUDGMENT / ORDER

1. The prisoner has taken-out this application through his wife for seeking parole leave for the period of one week as prayed by learned advocate for the applicant on account of giving solace and taking care of his daughter, who has consumed poison in recent past, though now she is discharged. The Court is of the view that the prisoner is in jail serving sentence for imprisonment for 3 years, fine is paid. Though, he has enjoyed parole leave from 28/05/2012 to 02/06/2012 and on earlier occasion also, furlough leave is also enjoyed in this very year. The ground urged for releasing on parole leave does not seem to be incorrect. Hence, a weeks parole leave is ordered to be granted to the prisoner from the date of his release on his executing personal bond of Rs.5,000/- (Rupees Five Thousand only) to the Jail Authority and on the following terms and conditions that he shall :
(a) not take undue advantage of his liberty or misuse his liberty :
(b) maintain law and order ;
(c) furnish the address of his residence;
(d) he shall surrender to the jail authority on expiry of his leave.
2. The application is allowed.
3. The order be communicated to the jail authority.
4. Direct service is permitted.
