This application under Section 482 Cr.P.C. has been filed for a direction to the Judicial Magistrate, Rath, District Hamirpur to decide the applicant's application dated 22.5.2018 moved under Section 323 Cr.P.C. in Criminal Case No. 122 of 2018, State of U.P. versus Ashok Kumar and others, arising out of Case Crime No. 425 of 2017, under Sections 147, 323, 325, 452, 504 and 506 IPC, P.S. Rath, Hamirpur.
Heard learned counsel for the applicant, learned AGA for the State and perused the record.
It has been made to appear that there is some application dated 22.5.2018 but no orders have been passed upon the same by the court below.
In the absence of complete record this Court is not in a position to know about the exact position and status of the case and reason why the orders have not been passed. At any rate, this application stands disposed off with the observation that if no order has been passed upon the same, the court below may look into it and pass proper orders in accordance with law, expeditiously.
