JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA) The applicant has sought condonation of delay of 113 days in preferring the appeal. It was fairly conceded by learned counsel Mr.Majmudar that the order of learned single Judge of this Court, which is sought to be challenged in appeal, is made in the petition calling into question award of the Labour Court, Vadodara in Reference (LCV) No.228 of 1995. Therefore, in view of the law laid down by Division Bench of this Court in Gustadji Dhanjisha Buhariwala v. Nevil Bamansha Buhariwala [2011 (2) G.L.H. 147], the appeal would not be maintainable. Under the circumstances, the present application for condonation of delay in the appeal, which is not maintainable, is not required to be entertained and hence dismissed.
