Petitioner claims to be working in the respondent orgnisation since the yer 2000. Reliance is placed upon the provisions of the 'U.P. Regularization of Persons Working on Daily Wages or on Work Charge or on Contract in Government Departments on Group 'C' and Group 'D' Posts (Outside the Purview of the Uttar Pradesh Public Service Commission) Rules, 2016' to submit that petitioner's claim for regulisation is liable to be considered as per the rules of 2016 but the authorities have not passed any order in that regard.
Sri O.D. Malviya, learned counsel appearing on behalf of respondent no. 3 states that the grievance of the petitioner shall be considered by the authority concerned, in accordance with law.
Considering the facts and circumstances, noticed above, this writ petition stands disposed of permitting the petitioner to represent his claim for regularisation before respondent no.3, alongwith certified copy of this order, within a period of three weeks from today, annexing all materials in support of such claim for regularisation. The authority concerned shall get the facts verified and appropriate decision shall be taken within a period of four months, thereafter. The petitioner's claim for payment of salary in the minimum of pay scale would also be examined in light of the observations made by Hon'ble Supreme Court in State of Punjab and others Vs. Jagjit Singh and others (2017) 1 SCC 148.
