JUDGMENT / ORDER

1. Mr.
N.D.Nanavati, learned Sr. Counsel with Mr. M.R.Yagnik, learned advocate for he applicant states that the applicant is in Jail since 27th November, 2009 and for one or another reason, the Sessions case is pending before the concerned Sessions Court & is not proceeding further. He, therefore, seeks permission to withdraw this application at this stage reserving the liberty of the applicant to move for bail in future and further states that the concerned Sessions Court may be directed to expedite the Trial of the Sessions case and for that purpose some time schedule may be framed.
2. Permission, as prayed for, is granted. The instant application stands disposed of as withdrawn at this stage reserving liberty of the applicant to move for bail in future, in case the Trial is not over by the concerned Sessions Court on or before 30th November, 2012.
3. Rule stands discharged. Direct Service is permitted.
