This Original Petition is filed challenging Ext.P3 order passed by the Tribunal in O.A.No.1989 of 2014. Ext.P3 order has been passed, on an application made by the petitioner seeking stay of her reversion from the post of Assistant Professor to the post of Lecturer in the Department of Higher Education Service. By the impugned order the Tribunal declined stay and ordered that the reversion will be subject to the out come of the O.A. and posted the O.A. along with the connected cases. It is this order which is challenged before us.
2. In our view the order does not suffer any perversity or illegality justifying interference in a proceedings under Article 226. The order itself shows that there are several cases of similar nature, where similar orders have been O.P.(KAT).No.370 of 2014 2 passed by the Tribunal. That apart, even if the order of reversion takes effect, depending upon the outcome of the O.A. the damage can be undone at the final stage. Therefore the balance of convenience also in favour of the view taken by the Tribunal. We therefore do not think that the petitioner has made out any ground for interference in this Original Petition.
The O.P.(KAT) is dismissed.
