JUDGMENT / ORDER

The petitioner is aggrieved with Ext.P5 order, only insofar as the petitioner having not been heard, before the order was passed. The petitioner contends that no notice was issued for the final hearing. A perusal of Ext.P5 would indicate that on 23.12.2009, when the final hearing was carried on, neither the petitioner nor the Counsel turned up for hearing. When revisions are considered before the Government, the same is not as per the pre-fixed date and notices are issued for every hearing conducted before the Government, as is evident from Ext.P4 notice, is the contention. The petitioner asserts that the petitioner was not present since no notice was received. 2. In such circumstance, Ext.P5 is set aside only for the reason of the petitioner having not been heard. The W.P.(C) No.11950 of 2011 - P 2 petitioner shall appear before the Secretary to Government, Co-operation (C) Department on 06.01.2015. The petitioner shall be issued with a date of hearing by the office of the said Secretary with due acknowledgment, if hearing cannot be held on that day. The petitioner shall also be permitted to make any written submission before the authority. The matter shall be heard and disposed of within a period of three months from the date of appearance of the petitioner.
The writ petition would stand disposed of on the above directions.
