JUDGMENT / ORDER

1. When the petition is called out and taken up for hearing, Mr. Kuntal Joshi, learned advocate for Mr. S.P. Majmudar, learned advocate for the petitioner and learned advocate for the respondents i.e. respondent other than respondent No.7 (The Joint Charity Commissioner) are present and have argued the petition. Learned advocate for respondent No.7 is not present.
2. It is noticed that in several cases where Charity Commission is party the learned advocate for the respondent No.7 is not attending the hearing. Because of absence of learned advocate for respondent No.7 the hearing of petitions are required to be adjourned from time to time.
3. Therefore, office is directed to forward copy of present petition to Charity Commissioner and concerned Joint Charity Commissioner to take steps to ensure that hearing are duly attended by learned advocate or appropriate orders including order of cost and / or direction requiring the Charity Commissioner or Joint Charity Commissioner to remain present will be passed. This order may be forwarded to the office of the Charity Commissioner and concerned Charity Commissioner with intimation that if on the next date of hearing learned advocate for the respondent No.7 is not present, appropriate order including order as aforesaid will be passed.
