Having considered the averments made in the application, the present application is allowed. The main matter being First Appeal No.963 of 2005 stands restored to file, on condition that the appellants shall file appropriate Civil Application in respect of unserved respondents within one week. If the Civil Application is not filed, the First Appeal shall stand dismissed, automatically.
