This application has been moved by the applicant (original petitioner) with the following prayers:-
(A) Applicant be permitted to correct and amend the names of Respondent no.1(B)(1) and Respondent No.4, respectively as stated in Para 2 and 3 hereinabove.
(B) Fresh notice of aforesaid Special Civil Application No.59 of 2012 be issued on Respondent No.1(B)(1) as per the said amended name and address.
(C) Such relief as the nature of this Civil Application deems fit be granted.
It is submitted by Mr.V.C.Desai, learned advocate for the applicant that in the cause-title of the petition, the correct name and address of respondent No.1(B)/1 is as follows:
1(B) Heir of deceased Dahyabhai Ganeshbhai B/1 Manubhai Dahyabhai, Adult, Residing at Khristivas At Village Sanjaya, Taluka Petlad, District: Anand It is further submitted that there is a typographical mistake while recording the name of respondent No.4, and the correct name of respondent No.4 is "Ramanbhai" and not "Ramabhai", as stated in the cause-title of the petition.
In view of the typographical and other errors pointed out by the learned advocate for the applicant, the prayers made in the application deserve to be granted. Accordingly, the following order is passed:
Applicant is permitted to correct and amend name of respondent No.1(B)(1) and respondent No.4 respectively as per the prayers made in the application. The necessary corrections to be carried out on, or before, 07.05.2012. After the necessary amendments/ corrections are carried out, fresh Notice be issued to respondent No.1(B)(1) on the amended name and address, making it returnable on 10.07.2012.
The application is disposed of in the above terms.
