Mr.Pandya, learned APP waives service of notice of Rule.

By way of this application, the applicant - convict has prayed that he be enlarged on temporary bail for partition of the property.

From the jail report, it transpires that the applicant - convict was enlarged on temporary bail in March, 2012 itself. On this count alone, discretion does not deserve to be exercised. Hence, the present application is rejected. Rule discharged.
