JUDGMENT / ORDER

Heard the learned counsel for the petitioner and the learned Standing Counsel for the respondents, apart from perusing the record. Since the issue lies in a narrow compass, this Court proposes to dispose of the writ petition at the admission stage itself. 2. The petitioner, an Assistant Executive Engineer (Electrical), while working at Moolamattom Generation Circle, Idukki District, represented to the respondent Board to transfer him to Vaikom, near to his native place, Kottayam, where his aged parents are stationed. Taking into account the petitioner's family constraints, the respondent Board issued Exhibit P1 order though which, apart from certain other employees, the petitioner was also WPC 28028/14 2 directed to be transfered to Electrical Sub Division, Vaikom. The grievance of the petitioner is that though Exhibit P1 order was issued on 02.08.2014, to this day, he has not been relieved from the present place of his working. Accordingly, he approached this Court by filing the present writ petition.

On perusal of the record and after appreciation of the rival submissions of the respective counsel for the petitioner and the respondent Board, I do not find any valid reason forthcoming from the respondent Board not to have implemented Exhibit P1 at an earlier date. At this juncture, the learned counsel for the petitioner has also brought to the notice certain judgments of this Court rendered on earlier occasions, involving the same respondent Board, on the issue of not relieving the employees even after their transfer.
WPC 28028/14 3 In the light of those judgments and especially given the fact that no sufficient reason has been supplied by the respondents for not implementing Exhibit P1, this Court, in terms of the judgment dated 04.02.2014 in W.P.(C)No. 2816/2014, disposes of the present writ petition by directing respondents 2 to 4 to relieve the petitioner on the basis of Exhibit P1 order of transfer at the earliest possible time, at any rate, within a period of two weeks from the date of receipt of a copy of this judgment.
