JUDGMENT / ORDER

The former is filed by accused nos.3 and 5 while the latter is filed by the 4th accused, in Crime No.1017 of 2013 of the Alappuzha South Police station for the offences punishable under Secs.406, 409, 468 and 420 read with Sec.34 of the Indian Penal Code. Petitioners apprehend arrest. 2. Learned Public Prosecutor has opposed the applications. It is submitted that the 1st accused is the order collecting commission agent and the 2nd accused, the manufacturing agent. The 3rd accused is supervisor of the Kerala State Coir Corporation Ltd. (for short, “the Corporation”) while accused nos.4 and 5 are officers in the Jeo textiles which was given the order for manufacturing of Jeotex for supply to various Panchayaths. Officials of the corporation inspected accounts etc. of Jeo textiles for the period, 2011-2013 and found grave irregularities and forgery etc. Invoices and orders were found forged. There was a deficit of Rs.1,04,84,066/- .It was found that quality of Jeotex which was said to be supplied to the panchayath was of low quality.
3. Learned counsel submitted that the allegations are not true. It is submitted that there is no allegation against accused no.3 to 5 that they forged the documents. There was also no possibility for that. It is submitted that the accused 1 and 2 settled claim of the corporation by deposit of a substantial amount. Certain documents are produced to show the alleged deposit.
4. On hearing both sides, I find that interrogation of these accused is required to find out the role if any played by these accused. As of now, serious allegations are made against these accused and that involves more than a crore of rupee of the corporation. In the circumstances, request for pre arrest bail cannot be allowed.
5. Learned Sessions Judge, Alappuzha while rejecting request for pre arrest bail directed these accused to surrender before the officer investigating the case. That date has expired. Hence it is directed that these accused shall surrender before the officer investigating the case on 27.06.2014 at 10.00 a.m. for interrogation, and on other dates as directed by the investigating officer in case interrogation is not completed. In case the petitioners are arrested, they shall be produced before the jurisdictional magistrate as early as possible.
The applications are disposed of with the above directions.
