FOR R3) THESE WRIT PETITIONS ARE FILED UNDER ARTICLE 226 AND 227 OF CONSTITUTION OF INDIA PRAYING TO QUASH THE IMPUGNED ORDER DATED 11.04.2017 AS PER ANNEXURE-K PASSED BY THE R-2 AND TO REMOVE THE MUTATION ENTRY EFFECTED IN THE NAME OF THE R-3 WITH RESPECT OF THE PROPERTIES IN QUESTION.
THESE PETITIONS COMING ON FOR ORDERS THIS DAY, THE COURT MADE THE FOLLOWING:
O R D E R Learned counsel appearing for petitioner has filed a memo stating thereunder that matter between petitioner and third respondent has been settled. The contents of memo reads as under:
“The petitioner filed the above petition challenging the order passed by the second respondent. The above matter is settled amicable between the petitioner and the respondent No.3 as per the settlement. The respondent has given 0.32 guntas and executed settlement deed in favour of the petitioner in respect of Sy.No.43 of Hasigala village, Sulibele Hobli, Hoskote Taluk, out of 3 acres 31 guntas which is item No.2 of the schedule property. Hence, the petitioners prays that this Hon’ble Court be pleased to dismiss the above petition as not pressed as withdrawn, in the interest of justice.”
Learned counsel appearing for third respondent has also endorsed on the said memo. Placing the said memo on record, petitions are dismissed as withdrawn.
