An order refusing to set aside the report and plan of the Advocate Commissioner in a suit for perpetual and mandatory injunction is impugned. It is unnecessary to delve deep into all the aspects since it is reported that the suit itself is listed for trial. 2. I permit the petitioner to adduce evidence at the time of trial of the suit in objection to the report and plan of the Advocate Commissioner. The court below is at liberty to remit the report and plan (during trial) if there is a distant doubt that the same is incomplete in any respects.
The order impugned does not affect the right of the petitioner at present warranting interference in the supervisory jurisdiction. The original Petition is dismissed subject to the above clarification.
