The petitioner is the joint owner of an extent of 45.713 cents of land in Kunnathunadu Village, Kunnathunadu Taluk. He wants to construct a small house in a portion of the land owned by him. According to the petitioner, the land in question has been remaining fallow for the past many years, for the reason that no agricultural operations have been conducted therein. According to him, he had submitted an application to respondents 2 and 3 for permission to make his construction, way back in June, 2012. However, they have not passed any orders, till date. The petitioner has therefore filed this writ petition for the consideration of his application. 2. The Government Pleader appears for respondents 1 to 3. According to the learned Government Pleader, it is the additional 4th respondent who has to consider such W.P.(C) No.2631 of 2014-Y -:2:-
applications. Since the petitioner has not made any application to the additional 4th respondent, it is for the petitioner to submit an application to the said authority.
In view of the above, this writ petition is disposed of directing the petitioner to submit a fresh application to the additional 4th respondent seeking permission for the construction of his residential house. If such an application is filed within a period of 10 days of the date of receipt of this judgment, the additional 4th respondent shall consider the same, conduct an inspection of the property, if necessary, verify records and shall pass appropriate orders on such application, in accordance with law, as expeditiously as possible and at any rate within a period of one month of the date of receipt of the petitioner's application.
