JUDGMENT / ORDER

This is a petition under Section 482 Cr.P.C. 2. Alleging cruelty committed by the present petitioner and his mother against the defacto complainant, who is the wife of the petitioner, Nedumkandom Police had registered Crime No.69 of 2010 under Sections 498A, 323, 506(1) IPC read with Section 34 IPC.
3. The Final Report has been filed in the matter and C.C.No.167 of 2010 of the Judicial First Class Magistrate’s Court, Nedumkandom was registered. The petitioner was the 1st accused in C.C.No.167 of 2010. As he was absconding, the case against him was split up and re-filed as C.C.No.98 of 2012. The trial against the 2nd accused, who is the mother of the petitioner, was conducted and she was acquitted through Annexure A3 judgment dated 20.03.2012.

4. C.C.No.98 of 2012 was later included in the LP Register as L.P.No.34 of 2012. The petitioner submits that the matter has been amicably settled between him and the defacto complainant, who is the 2nd respondent herein. Presently, the defacto complainant has no grievance against him.
5. The 2nd respondent has entered appearance through her counsel and the learned counsel for the 2nd respondent has also submitted that the matter has been amicably settled and there are no issues at present between the petitioner and the 2nd respondent.
6. On going through Annexure A3 judgment, Annexure A4 affidavit filed by the defacto complainant and on hearing either side, this Court is of the view that there is no meaning in proceeding with the matter involved in L.P.No.34 of 2012. Matters being so, Annexure A2 Final Report as against the petitioner and all further proceedings in L.P.No.34 of 2012 of the Judicial First Class Magistrate’s Court, Nedumkandom can be quashed.
Crl.M.C.No.6259/2014 : 3 :
In the result, this Crl.M.C. is allowed and Annexure A2 Final Report as against the petitioner and all further proceedings in L.P.No.34 of 2012 of the Judicial First Class Magistrate’s Court, Nedumkandom are hereby quashed.
