Jay vs Deputy

High Court Of Gujarat|21 May, 2012

JUDGMENT / ORDER

Heard learned counsel for the petitioner, while issuing the notice to the respondent ad interim relief was granted in favour of the petitioners by this Court in terms of para 8(C) vide order dated 21st September 2012. On a returnable date 5th October 2012 the respondents No. 3 and 4 were duly served.
Learned advocate Mr. S.M Shah appearing for the respondents No. 3 and 4 seeks time to get instructions from the respondents and to file his reply.
It has been argued by learned counsels before this Court that the Revision proceedings being No. 21/2008 is pending before SSRD and the respondents No. 3 and 4 are also attempting to pursue that and this would amount to nullify the order of stay as both the revisions cannot be pursued simultaneously.
Since one of the matters ie, Appeal No. 170/2012 is stayed by the Court, it is being further directed that the concerned authority shall not proceed with the revision No. 21/2008 as well till 30th October 2012.
Learned counsel Mr. Shah ensures to file affidavit by 30th October 2012 for clarifying the stand of respondents. The matter is posted on 30th October 2012.
