(Per : HONOURABLE THE ACTING CHIEF JUSTICE MR.BHASKAR BHATTACHARYA) This is an application for restoration of the appeal dismissed for non-compliance of our order dated April 10, 2012 by which we directed the appellant to remove the office objections within a week from that date with a further stipulation that in default, the matter would stand dismissed.
After hearing Mr Soparkar appearing on behalf of the applicant and after going through the explanation given in the application, we are convinced that sufficient cause has been made out for non-compliance of our order dated April 10, 2012. We thus recall the order dated April 10, 2012 and restore the appeal on condition that the office objections mentioned in our order dated April 10, 2012 must be removed by May 11, 2012. In default, the application will stand dismissed.
The application thus stands disposed of.
