Heard learned counsel for the petitioners, learned Standing Counsel who appears on behalf of respondents no. 1 to 3 and Shri B.K.Yadav learned counsel representing the respondent no. 4.
The writ petition is filed against the order dated 29.09.2015 passed by the respondent no. 2, Sub Divisional Magistrate, Kanpur Nagar (Sadar).
The contention of the learned counsel for the petitioners is that the impugned order passed by the Sub Divisional Magistrate is an order passed without jurisdiction.
Learned counsel representing the respondents has pointed out that the petitioners have not properly explained the delay in approaching this Court and further that the order impugned is appealable before the Divisional Commissioner.
In this view of the matter the writ petition is dismissed on the ground of availability of alternative remedy. It will be open to the petitioners to file an appeal/revision before the appropriate authority who shall consider the same in accordance with law.
