Ref: Civil Misc. Restoration Application No. 345558 of 2011 Supplementary counter affidavit and two rejoinder affidavits have been filed. Let it be taken on record.
Learned counsel for the respondents submits that the possession has been delivered to the respondents. Learned counsel for the petitioner does not dispute the said fact but submits that it is in the interest of justice that the writ petition may be restored and be heard and decided on merits.
Cause shown is sufficient. The order dated 21.11.2011 dismissing the writ petition in default is recalled. The writ petition is restored to its original number but it is provided that since the possession has already been delivered, the stay order is not restored.
List in the next cause list. It shall not be treated as tied up.
