Heard Sri Surendra Pal Singh, learned counsel for the petitioner, Sri Rajesh Bhatt, learned counsel holding brief of Sri M.K. Yadav for the respondent no.5 and the learned Standing Counsel for the respondents no. 1 to 4.
The petitioner in the writ petition is seeking a direction to the respondents to remove the illegal encroachment from old Gata no. 2326, new Gata no. 1278 area 4.5 acre which according to him is recorded as pond/bheeta in the revenue records, new Gata no. 1288 area 1.430 hectare, 1287 area 1.025 hectare, new Gata no. 1278 area 0.115 hectare, all of them are recorded as Bheeta situated in Village Hamjapur, Tehsil-Sadar, District Jaunpur. The relevant extract of the revenue record has been filed as Annexure-1 to the writ petition.
No useful purpose would be served in keeping the petition pending.
This writ petition is therefore, disposed of with a direction to the respondent no.4-Tesildar, Tehsil-Sadar, District Jaunpur to enquire into the matter and take appropriate action, in accordance with law, within a period of two months from the date of receipt of a certified copy of this order in his office.
It is made clear that the court has not adjudicated the claim of the petitioner on merit.
