Heard Shri Anand Mohan Pandey, learned counsel for the applicant and learned A.G.A. Perused the record.
By means of the present application the applicant, Ali Hasan is seeking his anticipatory bail in Case Crime No.40A of 2006, under Sections 409, 420, 467, 468, 471, 201, 218 and 120B/34 IPC, Police Station-Nagara, District-Ballia.
From the record, it is evident that the applicant has approached this Court after getting her anticipatory bail rejected from the Court of Session vide order dated 19.02.2021.
Since there is serious allegation of siphoning of Government Fund/property and ration of Below Poverty Line. In this regard the FIR was registered way back in the year 2006 but it is surprisingly that no charge sheet has been submitted in this regard as yet.
S.P., Ballia is directed to gear up the investigation and submits its report under Section 173(2) Cr.P.C. within two months from the date of production of certified copy of this order on the top most priority.
S.P., Ballia shall observe and have a close vigil over the matter that no laxity would be conducted by the Investigating Officer concerned in the investigation of the matter.
Let copy of this order may be placed before S.P., Ballia through learned AGA within a week from today.
With this observation, the present anticipatory bail application is hereby REJECTED.
