Heard learned counsel for the applicant. This is second contempt petition.
The instant contempt petition has been for flouting the order dated 24.04.2017 passed in Writ (C) No. 17232 of 2017. The writ court order reads thus:
"Heard counsel for the petitioner.
This petition has been filed for directing Naib Tahsildar, tahsil Sagri, district Azamgarh, to decide Suit No. 543/T-20161506071479 (Jay Prakash and others vs. Baljeet).
Without entering into the controversy involved in the matter, the petition is disposed of with direction to Naib Tahsildar, tahsil Sagri, district Azamgarh, to decide Suit No. 543/T-20161506071479 (Jay Prakash and others vs. Baljeet), expeditiously, without granting any unnecessary adjournment to either of the parties."
On specific query, learned counsel for the applicant is unable to show that there is any wilful or deliberate disobedience on the part of the opposite party in complying the order of this Court.
In view thereof, petition is disposed of as withdrawn with liberty to the applicant to make an appropriate expedite application. In the event, such an application is filed, the same shall be decided in accordance with law.
