Heard counsel for the petitioner, Sri Harsh Vardhan Gupta, counsel for the Respondents No. 2 and 4 and perused the record.
Submission of the learned counsel for the petitioner is that though the petitioner had been awarded weightage marks and held eligible for transfer, however at the relevant time, he was not offered transfer citing lack of vacancies. At the same time, it has been further submitted that the vacancies exist as other persons who had been transferred to the District sought by the petitioner have not joined. Her assertion is based on personal information. In such circumstances, no useful purpose would be served in keeping the present petition pending or calling for a counter affidavit at this stage.
Writ petition is disposed off with the direction that in case the petitioner files a fresh representation before the respondent no. 2 within a period of one week from today along with a copy of this order, the said respondent shall look into the matter and may allow for transfer, if any vacancy is found to be existing.
Copy of the order downloaded from the official website of this Court shall be treated as certified copy of the order.
